Snus is banned in the UK, nicotine pouches are not. That short answer has been true for years, but the legal basis changes on 29 October 2026, when the snus offences of the Tobacco and Vapes Act 2026 enter into force. The same date brings an age limit of 18 for nicotine pouches. This guide describes the law on 13 October 2026 and explains what changes on 29 October 2026.
In short
- Snus with tobacco may not be produced or supplied in the UK.[1]
- From 29 October 2026, selling snus, offering it for sale and possessing it with intent to supply it in the course of business are criminal offences.[3]
- Nicotine pouches without tobacco are legal. From 29 October 2026, it is an offence to sell them to anyone under 18.[3][6]
- Possession of snus for personal use is not named as an offence.[3][6]
Is snus illegal in the UK?
Yes, supplying snus is illegal in the UK. Regulation 17 of the Tobacco and Related Products Regulations 2016 states that no person may produce or supply tobacco for oral use.[1]
The ban covers tobacco that is meant to be kept in the mouth, such as Swedish snus in portions or loose form. On 29 October 2026, the Tobacco and Vapes Act 2026 takes over this role. It defines a "relevant oral tobacco product" as a tobacco product that is intended for oral use, is not intended to be inhaled or chewed, and consists wholly or partly of tobacco in powder or particulate form.[3] Chewing tobacco is outside this definition.
| Activity | Until 28 October 2026 | From 29 October 2026 |
|---|---|---|
| Producing snus | Banned[1] | Offence: manufacture of snus[3] |
| Selling or supplying snus | Banned[1] | Offence: selling, offering or exposing for sale[3] |
| Holding snus to supply it in the course of business | Covered by the supply ban[1] | Separate offence[3] |
| Owning snus for personal use | Not named as an offence | Not named as an offence[3][6] |
| Selling nicotine pouches | Legal, no statutory age limit in England, Wales and Northern Ireland | Legal, but not to under 18s[3][6] |
Why is snus banned in the UK?
The UK banned snus because of European rules and its own health policy. The current ban dates back to 1 January 1993, when the Tobacco for Oral Use (Safety) Regulations 1992 came into force.[2]
These regulations implemented Council Directive 92/41/EEC, which required all member states of the then European Community to ban tobacco for oral use.[2][7] The directive gave its reasons in the recitals: new oral tobacco products were particularly attractive to young people, and according to the International Agency for Research on Cancer they contain large quantities of carcinogenic substances.[7] The UK had tried earlier. The Oral Snuff (Safety) Regulations 1989 banned oral snuff, but the High Court quashed them in 1991.[2]
After Brexit, the UK is no longer bound by the EU ban, but it kept its own rules. With the Tobacco and Vapes Act 2026, Parliament decided to keep the ban and to write it into primary legislation.[3] The background of the EU ban is explained in our guide why is snus banned in the EU?
Is it illegal to buy snus in the UK?
The law addresses the seller, not the buyer. The offences in the Tobacco and Vapes Act 2026 concern manufacturing, selling, offering for sale and possessing snus with intent to supply it in the course of business.[3]
A shop that sells snus in the UK risks a fine or imprisonment. On conviction on indictment, the maximum penalty for selling snus is two years of imprisonment, a fine, or both.[3] The Act contains no offence for a private person who buys snus for their own use. Because no legal seller exists in the UK, snus that is offered for sale in the UK is offered unlawfully.
Can you buy snus in the UK?
Not legally. No shop, kiosk or online seller may sell snus to consumers in the UK.[1][3]
What UK shops do sell are tobacco-free nicotine pouches, which are often called "white snus". They look similar but contain no tobacco, so the snus ban does not apply to them. The difference matters, because the ingredient list decides which law applies, not the name on the can.
Is snus allowed in the UK for personal use?
Owning and using snus for personal use is not named as an offence in UK law. The possession offence in section 9 of the Tobacco and Vapes Act 2026 requires an intent to supply the product to another person in the course of business.[3]
This means that the law draws a line between personal use and trade. Larger quantities, repeated orders or products meant for friends or customers can raise the question whether the intent is to supply. In that case, the offence in section 9 can apply.[3]
Can you bring snus into the UK?
There is no rule that allows a fixed quantity of snus for travellers. The Tobacco and Vapes Act 2026 gives officers of HM Revenue and Customs the power to seize imported snus and detain it for up to 48 hours.[5]
The purpose of this power is to support the enforcement of the offence of possession with intent to supply.[5] The Act does not set out a separate ban on bringing snus for personal use. If you travel with snus, keep the amount clearly within personal use. Rules for flights are described in our guide on snus on a plane.
Are nicotine pouches legal in the UK?
Yes. Nicotine pouches without tobacco may be sold in the UK. They are not tobacco products, so the snus ban does not cover them.[1][3]
The Tobacco and Vapes Act 2026 regulates them as "nicotine products". The Act defines these as nicotine or any substance containing nicotine that is intended to be delivered into the human body, and items that contain it. Tobacco products, vaping products and licensed medicines are excluded.[4] The Local Government Association lists pouches, strips and pearls, including products with synthetic nicotine, as examples.[6]
How old do you have to be to buy nicotine pouches in the UK?
From 29 October 2026, you must be 18. Section 10 of the Tobacco and Vapes Act 2026 makes it an offence to sell a vaping product or nicotine product to a person under 18.[3]
Before this date, the age rule in England, Wales and Northern Ireland covered nicotine vapes only.[6] Three further rules start on the same day:[3][6]
- An adult who buys nicotine products for a person under 18 commits an offence.
- Nicotine products may no longer be sold from vending machines that customers can use.
- Trading Standards can issue a fixed penalty notice of £ 200 for an underage sale.
The buyer under 18 does not commit an offence.[6] The age limit does not apply to snus, because snus may not be sold at all.[6]
Online shops and age checks
The age rule applies to online sales in full. Online sellers must check the age at checkout and again at delivery.[6]
Regulations will set out the steps that give a seller a legal defence. Until then, a seller must show that it took all reasonable steps. According to the Local Government Association, a tick box, a typed date of birth or the use of a credit card is unlikely to meet this test.[3][6]
What else changes for nicotine pouches?
More rules will follow after October 2026. The Act gives the government powers over advertising, packaging, flavours and retail licensing.[6]
| Date | Change |
|---|---|
| 29 October 2026 | Age limit of 18 for vaping and nicotine products, snus offences in the Act, vending machine ban, £ 200 fixed penalty notices[6] |
| 1 January 2027 | Smoke-free generation: no tobacco for anyone born on or after 1 January 2009. This rule does not cover nicotine pouches.[6] |
| 1 June 2027 | Planned date for the advertising and sponsorship ban for vapes and nicotine products[6] |
| 2027 to 2029 | Rules on packaging, display and contents, retail licensing and product registration, after consultation[6] |
How the UK compares with EU countries is shown in our overview of snus laws in Europe. Sweden, the only EU country where snus may be sold, is covered in snus in Sweden.
